A pre-nuptial agreement is an agreement entered into by a couple who are intending to marry and who set out how the main financial assets are to be divided upon Judicial Separation or Divorce. At present, Ireland and the United Kingdom are the only countries in the EU that do not have legislation on pre nuptial agreements.
Pre-nupital agreements are not illegal in Ireland but the parties entering into the agreement are not bound by its terms but the courts can in some instances be guided by the agreement when making its decision in relation to the division of financial assets.
