A 23 year old woman has been awarded €8,000.00 in compensation after taking a personal injury accident claim against a nightclub in Finglas.

The woman took the compensation claim against the nightclub in Finglas as a result of the injuries she suffered and she said the nightclub was negligent and in breach of its duties.

The Court heard the woman was returning from the smoking area in the night club when she slipped and fell backwards on a liquid spillage injuring her back. The woman told the Court that immediately after her fall she saw a cleaner with a mop but that there was no wet floor warning signs that might have alerted her to the potential dangers.

The injured woman later attended her GP who prescribed her paracetamol, painkiller tablets and also recommended that she could take solpadeine.  Counsel for the nightclub informed the Court that the injured woman had been video recorded dancing in the same nightclub five months after the accident and that she appeared to be moving pain free.  The injured woman informed the Court that she was only 23 years old and that she had to get on with her life which she did by taking the painkillers.

The Judge awarded compensation €8,000.00 plus costs as a result of the personal injury accident claim and noted that the Manager of the bar had acknowledged that there had been a spillage and moping up in the area where the woman was injured.

In this type of situation, the woman would have had to make an initial application to the injuries board. The Injury Board would have assessed her injuries if the other party consented to this. The Injuries Board would have given her an authorisation to bring the court proceedings for her personal injury claim as a result of the accident.
