The boy’s family took a medical negligence personal injury claim against the Health Service Executive on his behalf over injuries suffered at his birth in November 2004. The High Court was told that medical staff at the Erinville Hospital failed to act quickly enough after a foetal heart monitor showed abnormalities in his heart rate. The High Court was told that the staff had negligently carried out a forceps delivery and that if the boy had been delivered earlier by Caesarean Section, he would not have suffered the damage. The boy suffers from cerebral palsy and developmental problems as a result of the negligence of the hospital and its medical staff. The Hospital acknowledged and apologised for the events that led up to his birth and that occurred during his birth.
The High Court approved the interim settlement which would cover the boy’s care and needs for the next 2 years. The boys needs and care requirements will be assessed during this period and further periodic payments could be made to the boy over his lifetime by the HSE.

Boy injured at birth gets one million interim damages
The High Court has approved an interim settlement of just over one million euro for a 7 year old boy who was injured at birth at a Hospital in Cork.
